The company’s American units filed a lawsuit in the US Court of International Trade on Jan. 26, arguing that a suite of executive orders that underpin the tariffs are invalid, making the collection of the duties unlawful, according to the filing.

While BYD currently does not sell passenger cars in the USA, the Chinese company does manufacture and sell electric trucks, buses, batteries, energy storage systems and solar panels, where it is paying duties for production materials. Should the situation change, the US electric car market is likely due to see more international competition, however.

As BYD argues, there is currently a US Supreme Court decision pending on the legality of Trump’s signature levies, however, BYD’s units argue that the lawsuit is also necessary, “as they’re not assured of a refund in the absence of their own judgment and judicial relief,” as Bloomberg writes.

This lawsuit is not the only opposition the Trump administration is facing on its tariffs, as more than 1,000 corporate entities, including Costco and Goodyear are also suing for refunds for their share of the billions of dollars in tariffs that the US has collected so far.

While the U.S. president has not commented on the newest additions to the lawsuit, when it was filed, Trump stated the proceedings would cause a “complete mess,” adding: “It would take many years to figure out what number we are talking about and even, who, when, and where, to pay.”
